EXPIRATION This proposal will expire 15 days from the original proposal date. WARRANTY When applicable, the operations manual (which includes the manufacturer's detailed warranty information) will be left on site with your new equipment/parts. Temperature Service (Seller) shall warrant labor for a period of one year from date of installation. The equipment, parts and/or materials furnished by us will be covered by the manufacturer's warranty. Existing equipment, parts and/or materials and their connected utilities (gas, electrical, plumbing, ductwork, refrigeration lines, etc.) are excluded from this warranty. This includes parts supplied by the customer. If a claim is made under these warranties, the seller reserves the right to repair or replace defective parts and/or equipment. Seller also reserves the right to deny any warranty claims if: a. The customer's account is not current and/or not in good standing. b. An entity not authorized by seller works on the equipment. c. The equipment is moved, relocated, altered, or allocated for a different purpose. d. The equipment has not been properly maintained per the manufacturer's requirements. e. The equipment/parts are damaged due to accidents, fires, weather, earthquakes, etc. Service under these warranties will be provided by seller during normal business hours: 8am - 5pm Monday through Friday. Routine maintenance by seller is not included under these warranties. GENERAL TERMS Refrigerant recovered is done per EPA 608 guidelines. Any old materials, parts and/or equipment removed from the job site are recycled as much as possible. Straight time work will be performed between the hours 8am - 5pm Monday through Friday. Overtime hours are billed out "port to port". While performing work, seller shall take all reasonable precautions to protect persons and avoid damage to property. Buyer's Right to Cancel: The Buyer may cancel this contract by notifying Seller of the intent to cancel in writing and delivered in person to the Seller's office by the end of business on the third day from the date of this transaction. The deposit (all or a portion) may be withheld by the Seller as an offset of costs incurred upon order cancellation for reasons not linked to the Seller's performance or control. Seller makes no guarantee, representation, or warranty, express or implied, including but not limited to any implied warranty of merchantability or implied warranty of fitness for a particular purpose. Seller and its employees are not liable for any general, direct, indirect, special, consequential, exemplary, punitive, statutory or other damages for any breach of contract, breach of warranty, negligence, tort, or other cause arising from the performance or non-performance of this contract, and in the event of any such liability against seller and its employees, such liability shall be limited to the cost of the labor, materials and property provided by seller. Seller shall not be liable for damages in the event of delivery delays or installation delays due to accidents, fires, weather, earthquakes, or any other acts of God, strikes, the inability to procure materials from the usual sources of supply or any causes beyond seller's control. Seller will not be responsible for the abatement of any asbestos containing materials encountered during working conditions. Seller will not be held liable for any delays caused by inability to work until such conditions have been corrected according to EPA guidelines and standards. Seller retains title to all materials and property listed herein until payment has been made in full. Payments are to be made on a progress basis. Payment must be made within ten (10) days of receipt. Accounts that are in default will incur a late payment charge (computed by a "periodic rate" of 2% per month or the maximum allowable by law). If payment is not received within 60 days, a mechanics lien will be placed on the property where work was performed. Purchaser agrees to reasonable attorney and/or collection fees incurred by seller in securing payment for this contract. The maximum allowable service fee by law will be charged on all returned checks. The warranties and liabilities set forth above are in lieu of all other warranties and liabilities, expressed or implied, in law or in fact. EXCLUSIONS Warranty and/or repairs on the existing air distribution systems or their connected utilities. Excluded utilities include the existing gas piping, existing flue piping, existing drain piping, existing plumbing, existing power wiring, existing electrical disconnect, existing low voltage controls and wiring. Also excluded if not listed in the scope of work: Air balance, roof seal, thermostat, low ambient controls, humidifier, condensate pump, electronic air cleaner, other accessories.
